1. Acceptance of Terms
By downloading, installing, or using AtWork ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legal agreement between you ("User") and AtWork ("we", "us", or "our"). We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any modifications.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices that you own or control, subject to these Terms and the Apple App Store and Google Play Store terms of service.
You may NOT:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse-engineer or attempt to extract the source code
- Use the App for any unlawful purpose
- Transfer your license to another person without our consent
- Use automated systems (bots, scrapers) to access the App
3. User Account
To access certain features, you may need to create an account using Google Sign-In or Apple Sign-In. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.
4. Acceptable Use
When using AtWork, you agree to:
- Provide accurate attendance records and employee information
- Use the App solely for legitimate attendance tracking and workforce management purposes
- Not manipulate GPS or WiFi data to falsify attendance records
- Not upload any offensive, illegal, or harmful content
- Not interfere with or disrupt the App's servers or networks
- Not attempt to gain unauthorized access to any part of the App
โ ๏ธ AtWork is an attendance tracking and management tool. Falsifying attendance records or manipulating location data may result in account suspension and is subject to applicable laws.
5. User Content
You retain ownership of all attendance data, employee records, and content you enter into the App. By using cloud sync, you grant us permission to store and transmit your data solely for the purpose of providing the service.
Feature requests and feedback submitted through the App may be used by us to improve the service without obligation of compensation.
6. Subscriptions & Purchases
AtWork may offer premium features through in-app purchases or subscriptions ("Premium"). By purchasing a subscription:
- Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
- You can manage and cancel subscriptions through your device's account settings
- No refunds will be provided for the unused portion of any subscription period, except as required by applicable law
Free features will remain available without subscription. We reserve the right to modify pricing and features with prior notice to active subscribers.
7. Group Owner Responsibilities
If you create an attendance group as a Group Owner (employer, manager, or administrator), you acknowledge and agree to:
- Comply with local labor laws and regulations regarding employee attendance tracking
- Inform your employees about the use of GPS and WiFi-based attendance verification
- Use collected attendance data responsibly and in accordance with applicable privacy laws
- Not use the App's location features for purposes other than attendance verification
- Be responsible for managing employee access, roles, and permissions within your group
๐๏ธ Group Owners are responsible for ensuring compliance with local labor and data protection laws when using AtWork for employee attendance tracking.
8. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding:
- The accuracy of GPS-based location verification
- The accuracy of payroll calculations or reports
- Uninterrupted or error-free operation of the App
- The security of data transmitted over the internet
- Compatibility with all devices or operating system versions
To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, AtWork shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Losses arising from your use of or inability to use the App
- Inaccurate attendance records due to GPS/WiFi signal issues
- Payroll discrepancies based on automatically calculated data
- Unauthorized access to your data
- Decisions made based on information provided by the App
10. Termination
You may stop using the App at any time. You can also delete your account through the App (Settings โ Delete Account), which will permanently remove all your data.
We may terminate or suspend your access at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the competent courts of Vietnam.
